What you may do with the software we resell and the material we hand over.
ACALA delivers three different kinds of thing: GEOVIA software licensed by Dassault Systèmes, training material and course notes written by us, and project deliverables produced for a specific client. Each is licensed differently, and confusing them is the most common cause of a dispute. This page sets out which is which. Last updated 8 September 2026.
Three different things, three different licences
When ACALA sends you an invoice, it usually covers one or more of the following, and the rights you get are not the same in each case.
- GEOVIA software — Surpac, Whittle, MineSched, Minex and the 3DEXPERIENCE platform. Licensed to you by Dassault Systèmes, not by us. We are the reseller.
- Training material — course notes, exercise sets, sample datasets and recordings that ACALA wrote. Licensed to you by us, for learning.
- Project deliverables — the estimate, model, plan, valuation or report we produced for your deposit. Ownership passes to you on payment, under the engagement contract.
Where this page and a signed engagement contract, quotation or purchase order disagree, the signed document wins. This page fills the gaps.
GEOVIA software
Your right to install and use GEOVIA software comes from the licence agreement between you and Dassault Systèmes, accepted when the software is installed or activated. We do not grant that licence, we cannot vary it, and we cannot waive its restrictions. What we do is sell the licence, arrange activation, and support you in using it.
Practical consequences worth knowing before you buy: licences are issued to a named legal entity and are not freely transferable between companies in a group; the number of concurrent users is what you paid for, and sharing a single licence beyond that is a breach; module boundaries are real, so a workflow demonstrated in training may need a module you have not licensed; and maintenance entitles you to updates for the period you paid for, after which upgrading is a new commercial decision.
If you need to move a licence, add users, or check whether your configuration covers a workflow, ask us in writing before you rely on it. We would rather answer a question than resolve a dispute.
Training material
For course notes, exercises, sample data and recordings that ACALA produced, we grant the organisation that paid for the course a non-exclusive, non-transferable, perpetual licence to use the material internally, for the purpose of learning and applying the workflows taught, by the people employed or contracted by that organisation.
That licence includes making internal copies for your own staff, using the material to build your own internal procedures, and keeping it after the course ends. It does not include reselling it, publishing it, teaching it commercially to third parties, or supplying it to a competitor of ACALA in the training market.
Where a course is delivered on your own project data, that data stays yours throughout and we do not reuse it for other clients. We prefer to teach on your data precisely because sample-data training rarely transfers to real work; where confidentiality prevents it, we build a synthetic dataset that behaves like your deposit, and that synthetic dataset remains ours.
Recordings of a course are made only where you have asked for them and everyone present has been told. They carry the same licence as the notes.
Project deliverables
The report, model, block model, pit design, schedule, valuation or dataset we produce under an engagement is yours on payment in full. You may use it, publish it, submit it to a regulator or an exchange, and hand it to your auditors, subject to the disclosure conditions in the engagement contract and, where the work carries our sign-off, to our written consent to the form and context of the disclosure.
Two things stay with us. The first is our general know-how: methods, scripts, macros, templates and internal tooling we brought to the job or developed generically, which we go on using for other clients. The second is anything we licensed from a third party for the job, which we pass through on the third party’s terms.
We keep a working copy of your project files for the retention period set out in Data protection and compliance, so that we can answer a question or defend the work if it is challenged. You can ask us to destroy that copy earlier and we will, subject to what a professional body or a regulator requires us to retain.
Academic licence programme
Software supplied under the academic programme is licensed for teaching and non-commercial research only. It may not be used for consulting work, for commercial resource estimation, or for any study that a company will rely on. Universities in the programme accept that condition when they join, and it is the vendor’s condition, not ours.
Student work produced on an academic licence belongs to the student and the institution under their own rules. If a student’s work later becomes the basis of commercial reporting, a commercial licence is required first.
Restrictions that apply to everything
Across all three categories, you agree not to: remove or obscure a copyright notice, trademark or attribution; reverse engineer, decompile or disassemble software except where the law expressly allows it; circumvent a licence key or usage limit; publish benchmark results for GEOVIA software without the vendor’s consent; or present ACALA material as your own work when supplying it onward to a third party.
Third-party components
Software and material may include components licensed from others, including open-source components. Those components stay under their own licences, which prevail over this page for the component concerned. Where we deliver material containing such components we identify them, and where a licence requires it we supply the notice or the source with the delivery.
Test before you rely on it
Scripts, macros and configurations we supply are written for the environment we saw and the data we were given. Software versions change, and a macro that ran last year may not behave the same way after an upgrade. Run anything we give you against a known result before you put it in a production workflow, and tell us if it does not reproduce; we will look at it.
Warranty and liability
We warrant that services are performed with the skill and care expected of a competent professional in our field, and that we have the right to grant the licences described here. Beyond that, material is supplied as it is. We do not warrant that software is free of defects, that a workflow will suit a purpose we were not told about, or that a result will be accepted by a particular regulator or exchange.
Our liability for any engagement is limited to the fees paid for that engagement, except for liability that cannot be limited by law, and except in cases of fraud or wilful misconduct. We are not liable for indirect or consequential loss, including loss of profit, loss of production, loss of opportunity or the cost of a delayed decision. Where the loss concerns GEOVIA software itself, the vendor’s own limitation applies and we have no wider liability than the vendor accepts.
Term and termination
Licences to training material and deliverables are perpetual and survive the end of the engagement. Software licences run for the term you bought and end as the vendor’s agreement says. If a licence granted by us is terminated for a serious and uncured breach, you stop using the material and, if we ask, confirm in writing that copies have been deleted; that does not affect deliverables you have already paid for and lawfully published.
Governing law and language
These terms are governed by the law of the Republic of Indonesia, and disputes go to the courts of Indonesia unless the engagement contract names arbitration. Where an Indonesian translation is provided and the two differ, the Indonesian version prevails.
Contact
Licence questions, transfer requests and permission queries go to office@acala.co.id with the invoice or quotation number, if you have one.
Next step
Not sure which licence covers what you have? Ask before you rely on it.
